【明報專訊】一名本那比華裔女子攜帶近1.3萬元現金企圖從溫哥華機場飛往香港，結果被加國海關發現她沒有申報超過1萬元現金，更以洗黑錢等相關罪名起訴她，法院日前裁判她罪名成立，是卑詩省首宗成功以洗黑錢罪名、將黑錢帶出境而獲罪的案例。

被判罪名成立的是37歲的楊姓女子(Oksana Yang)，皇家騎警昨日發出新聞稿稱，在2009年5月27日，楊姓女子從溫哥華國際機場搭機前往香港，但在經過溫哥華機場時，被海關「選中」作進一步搜查，結果發現她攜帶等同1.29萬加元的現金而並無申報。

新聞稿指出，根據加國防止洗黑錢及資助恐怖活動法(Proceeds of Crime (Money Laundering) and Terrorist Financing Act)，任何人帶超過1萬元現金入境及出境並非犯法，但他們都必須向海關如實申報，此法的目的是，令通常以現金交易的犯罪分子，更難運送黑錢。

楊姓女子接受邊境服務局(CBSA)關員盤問時，對於她此行目的、她擁有該筆現金及為何攜帶該筆現金等問題，無法說服關員該筆現金是合法途徑所得，關員於是根據防止洗黑錢法例，將該筆現金沒收，並將她的個案轉交皇家騎警整合洗黑錢組接手深入調查。檢控部門及後根據騎警的調查，起訴楊姓女子。

卑詩黑錢出境首例

結果，在本年3月23日，卑詩省級法院判決楊姓女子罪名成立，成為卑詩首宗成功以洗黑錢罪名、將黑錢帶出境而罪成的案件。

CBSA溫哥華國際機場區域總監格雷(Yvette Monique Gray)表示，在邊境堵截沒有申報的黑錢是CBSA重要任務之一，也顯示了CBSA與皇家騎警的合作無間，有效打擊跨國犯罪活動。

CBSA發言人利比(Pennie Libby)昨日進一步解釋，海關以往曾多次成功堵截黑錢帶入加拿大境，但此案則是首宗將黑錢帶出境而獲罪的案例。

她舉例，帶黑錢入境而罪名成立的案件有去年12月判刑的Jonathan Smith，他被罰款1萬元、入獄6個月、40個小時社區服務，以及充公價值16.5萬美元的財產。在另一例中，John Quigley被罰款2.1萬加元、緩刑1年、充公價值16.1萬美元的財產。

fibbi: they won't be "don't know" ga, a lady walking by and ask ppl whether or not they've brought more than $10k and it has been said on the forms, they cnanot pretend to be naive and naive isn't an excuse for criminals, won't work

I understand no excuse la..but then...I really don't know that I need to "declare" when i bring cash out of canada wor...I only know i have to declare when I bring in so much cash. Not that I have that much cash to bring in/out anyway...
