警大搜恒基查串謀詐騙
律師樓蒐證秦善文恒基職員等11人助查
【明報專訊】天匯事件有新進展，警方商業罪案調查科昨晨以「買家與賣家串謀詐騙」理由，向法院取得搜查令，派出60多名探員兵分多路，到國金二期的恒基地產總部、撻訂買家之一秦善文的公司，以及律師樓等10多處地點搜查，至傍晚至少帶走了11人返署協助調查，包括恒地職員及撻訂買家秦善文，檢走大批文件。行動仍續進行。警務處長鄧竟成強調，「不會放過任何涉案人士」。

鄧竟成﹕不放過任何涉案人

鄧竟成昨午出席一公開場合後，回應傳媒提問時證實，商罪科昨到部分地點搜查，帶走一些文件調查，亦邀請了一些人士到警署助查，但目前並沒有拘捕任何人。不過，「案件複雜，涉及的人士不少，警方會循多角度、多方向調查，不會放過任何涉案人士」。

恒基﹕歡迎調查全力配合

恒基地產昨晚發表公告表示，警方昨到公司總部調查有關「天匯」的交易，恒地提供了相關文件，並應邀派出職員協助調查；公告歡迎警方調查，將全力配合提供資料，希望事件能早日水落石出。

消息稱，商罪科上月中開始翻閱天匯資料，研究有沒有地方可以跟進，以及有否涉及違規行為。經過近一個月調查，警方昨以「買家與賣家串謀詐騙」為由，向法庭取得搜查令，由大案經驗豐富、曾調查陳振聰涉嫌偽造文件案的訛騙案調查組A、B兩隊作主力，由女總督察郭麗嫺帶領60多名探員，兵分多路出發到多處蒐證。

商罪科女警官帶60人調查

其中一隊探員早上到中環國金二期恒地總部辦公室，檢走一批文件後，邀請恒地職員返署助查；另一批探員差不多同一時間，到撻訂買家之一的秦善文位於西環的公司搜查，公司職員昨午證實警方曾上門搜查，但不肯透露秦善文動向。另外，有探員到中環環球大廈為恒地處理契約工作的羅文錦律師樓調查，傍晚6時半左右，探員從律師行搬走兩箱文件返署。記者昨午曾到律師行查問事件，職員只回應「不知道」。

據悉警方亦有到其他撻訂買家報住地址搜查，至昨傍晚至少已帶了11人返警察總部助查，包括秦善文。另有消息稱，調查只屬很初步階段，探員昨日並無與恒地主席李兆基及其兩名兒子李家傑及李家誠接觸。

恒地營業部總經理林達民昨午接受本報查詢時回應稱，「家開緊會，唔得閒，你找公關Bonnie(恒地企業傳訊部總經理顏雪芳)」。昨午記者亦就此向恒地副主席林高演查詢，但其秘書稱他正在開會，至截稿前未有回覆。

串謀詐騙罪成可判14年

根據刑事條例，串謀詐騙若罪成，最高可判監14年。不過，本身為資深大律師的公民黨立法會議員湯家驊表示，詐騙罪的門檻很高，因為要證明有犯罪意圖，並且有受騙對象，受騙者蒙受損失。

湯家驊估計，今次警方這樣高調，可能是因為前日特首曾蔭權在答問大會「誓神劈願」要跟進天匯事件，故行動有政治意味。警方到律師樓搜查，似乎目標是想調查買家的底細，可能是看買家和恒地是否有合謀，故將調查方向定為串謀詐騙。據了解，商罪科訛騙案調查組兩周前突然收到指示，要求短時間內要有行動。

另外，民主黨涂謹申透露，恒地在本年3月的年報中，交代天匯單位成交時特別提到有24個單位買家要求延期付款，雖然沒有理由相信單位最終不能成交，但若最終未能完成交易，「在未計及重售該批單位的情下，集團會在沒收訂金後，錄得應佔虧損港幣7.8億」。涂謹申認為，地產公司在年報中特意提到不成功交易的情十分罕見，質疑是核數師擔心要為事件「上身」而刻意這樣寫。

去年10月天匯開售，發展商恒地稱已售出約25伙，包括呎價達7.1萬元、世界最貴分層住宅的68樓A室，惹起社會關注交易是否真實，政府先後去信7次要求恒地解釋，追問交易詳情。至今年6月，恒地宣布20伙未能完成交易。

There is talk that Uncle 4 is being turned into an example because of his past arrogant stance against the SAR government. Specifically, it was some old grudges that came about back when LMD was still the CEO, and Uncle 4 openly did not pledge support for LMD.

We'll see how this one turns out la.

If there are issues with this real estate transaction, then the government should do some investigation. There is no relation to the previous HK CEO uncle Tung whatsoever.

法庭大Q晒呀？特別係今時今日嘅特區法院同埋件黃淫龍，根本就係偏袒達官貴人、大有錢佬、同有權有勢果啲。街邊雪糕車賣多少少野就拉咗去告，高官子女偷野就話唔告先至符合公眾利益。買(食送)呃秤就又拉又鎖，地產發展商嘅樓宇面積可以呃成 25%個政府同法院都可以唔做野。呢啲叫做公義？！

其實秦生先幾個月前一早探口風話會撻訂，佢個時話：「如果我撻訂，個市一定冧!!」
之後又要講：「傻啦，我又點會做呢D損人不利己既事~~」
明顯係冇人接貨賣唔出，要脅恒基「做野」幫佢搵客。

乜都好啦，唔係有人實牙實齒話一萬賠一百萬咩？？？

I agree with Lik this time. Those who believe in law and justice are just plain stupid or naive. In this world, only two things matter - power/politics and money. Anything else is just for show. Therefore, if you want to succeed, you either side with those in power or those who control the market.

That's why it's a trouble to have the democrats ruling. When the republicans are in power, politics = money. But now the relationship is not as simple.

In Hong Kong, if there is evidence, the HK police would take action on those triads. So both in HK and Canada are the same, the police would act if there is evidence.

Back to the topic of this thread. What HK police did with regard to those real estate transactions, has nothing to do with uncle Tung whatsoever.

it is not about "catch them all", you can not win it all anyways.
It is about balance, catching Becons was to sending a message to "settle down".
Messing with uncle 4 is another.
"You better keep it low" that's the message they want to send.

立法會否決李永達動議用權力及特權法公開天匯書信

立法會否決民主黨李永達動議，要求運用權力及特權法，要求運輸及房屋局長鄭汝樺到立法會，公開政府和恆基地產就西半山豪宅天匯交易的文件書信往來。鄭汝樺表示，政府已經把地政總署送交恆地的九封信，全數提交立法會，又說警方和相關部門正全方位調查事件，絕不容許有弄虛作假，現階段不會披露更多調查細節和資料。

提出動議的李永達形容，天匯事件匪夷所思，批評政府一直無提出有效措施，規管樓花買賣。公民黨梁家傑懷疑事件，涉及在樓市和股市造價托市。不過多名功能組別議員反對動議，認為政府已經提交所有相關書信，立法會現階段不宜介入。

早說都不過是場戲...戲軌早已定了, 結局亦人人心中有數...
