Ontario judge rules the ban is not a breach of the charter
VANCOUVER (NEWS1130) - An Ontario court judge has upheld a ban on men who have had sex with other men since 1977 from giving blood. Some are calling it a big step in the wrong direction.

Catherine Aitken has ruled blood donation is not a right, it's a privilege. She adds the policy doesn't discriminate and the charter doesn't apply to Canadian Blood Services because it's not a government entity.

However it's a concern for G.L.B.T. advocate, Jennifer Breakspear, with the Vancouver advocacy group Qmunity. "We do have great advances in medical technology and we also have great advances in societal understanding. So I'm concerned about where the court is taking this."

Canadian Blood Services recognizes this has been the most controversial of its policies and is still under review, but explains it's meant to prevent recipients from contracting HIV/AIDS

When you donate blood, the nurse will verbally ask you at least twice.
1) Have you had sex with a male since 1977 ?
2) Have you had sex with a female whom had sex with a male whom had sex with a male ?
