滿18歲智障生不獲資助

【明報專訊】本年9月，特殊教育學校將與主流學校一同推行新高中學制，但部分特殊學校近月接獲政府通知，除特殊情况外，年滿18歲學生將不獲政府資助。有立法會議員批評此舉欠法理依據，亦對智障學生不公平，家長或可提出司法覆核。

關注特殊教育權益家長大聯盟指出，不少特殊學校今年突然收到教育局通知，指自9月起，所有18歲以上的學生將不會計算在來年學生人數內，亦即不受政府資助，但教育局不反對學校繼續招收這些學生。在過去一年曾代表香港出賽和受訓，或者缺席超過半年的學生可獲豁免，但延遲入學、新來港或長期病患的學童都不能豁免。

需較多時間學習未必6年讀完

現行學制下，智障學生完成6年小學和4年初中後，另有兩年延伸教育計劃，即學生有6年時間完成初中課程，部分18歲以上學生可申請留校直至最多20歲。在新高中學制下，6年初中課程變為3年初中和3年高中，不設延伸教育。由於智障學生需要較多時間學習，未必能在6年內完成初中和高中課程，故被批評為「假高中」。

大聯盟指出，2008年修訂的特殊學校資助則例訂明特殊學校學生的就讀年齡上限為20歲，而且有學習障礙的學生應有較長學習年期，教育局突然訂立18歲「死線」並不合理，亦欠缺法理依據。由於主流學校學生不受年齡限制，大聯盟擔心新制度會令更多家長把智障子女送到主流學校讀書，引發更多問題。

佛教普光學校校長何巧嬋表示，部分智障學童入讀主流學校，不少人到十多歲時才發覺不能適應融合教育，轉到特殊學校留級或重讀。但在新制度下，這些學生只能讀到18歲，不足以完成高中課程。即使學校願意額外接收18歲以上的學生，學校資源亦會被攤薄。

議員批不公家長可司法覆核

家長大聯盟要求教育局把18歲以上的學生納入來年的學生人數，並以20歲為學生離校基線，在合理情况下讓20歲以上的學生留校。

香港理工大學社會科學系講師張超雄博士說，主流學校學生沒有年齡限制，特殊學校學生則受18歲所限，有違平等原則。立法會議員陳淑莊表示，家長可申請司法覆核禁制教育局實施有關限制。

教育局首席督學（特殊教育支援1）黃錦榮表示會研究家長訴求，但由於香港的特殊學校佔少數，每年仍不斷有新生入學，規劃上有需要設定18歲限制，但會彈性執行，過去3年申請留校的18歲以上學生有九成獲得批准。他指勉強把學生留在學校也是「沒有得着」。

全港逾六十所特殊學校，今年九月將與主流學校一同推行新高中學制。根據教育局○六年公布的《職業導向教育及特殊學校的新高中學制》顯示，一般智障學生在六歲入學，通過六年小學、三年初中、三年高中後，離校年齡為十八歲。

現時，智障學生因健康或其他理由可申請延長留校學習至最多二十歲，但教育局月前通知特殊學校，表示所有十八歲以上的學生不會計算在來年學生人數內，亦即不受政府資助，並將離校「死線」訂在十八歲。

由於智障學生需要較多時間學習，未必能在六年內完成初中和高中課程，因此被批評為「假高中」。關注特殊教育權益家長大聯盟召集人趙太說，教育局可能已違反《殘疾歧視條例》，對智障學生造成不公平，或會提出司法覆核，昨日就事件已向平機會申訴並獲接納。

佛教普光學校校長何巧嬋表示，當局以「學生學制已完結」為理由，拒絕智障學生延長學習。「他們跟主流學生一樣有學習的權利，不能貿然中斷學習的機會。」

香港理工大學社會科學系講師張超雄說，將於六月八日集合數百位家長在立法會門外請願，希望當局急切處理事件，讓智障學生年齡不設限。

阿力睇完呢段新聞之後真係怒火中燒！！！你呢個係咩「不該」政府來㗎？！你有無良心、知唔知咩叫做仁義道德㗎？18歲以上嘅智障學生就唔受政府資助，但主流學校嘅學生就無年齡限制，你咁樣都唔算「不該」嘅話，咁要點先至算係？！你個「不該」政府要諗縮數都唔係響啲弱勢社群身上打主意㗎？！你班狗官就個個高薪厚祿月入幾廿皮，但人地普通人家有個智障小朋友，你就重要響人地身上打主意，你知唔知道咩叫做羞恥？！

I support you this time. Even for 20, I still believe it is not enough for mentally challenged people. I would say the limit should be set at 25.

力兄, 唔好成日都怒火中燒喇... 你年紀都有番咁上下, 太衝動既話, 可能對身體唔好的.

小弟覺得應該平等d 先得既, 18歲以上嘅智障學生就唔受政府資助，但主流學校嘅學生就無年齡限制, 咁樣真係好唔公平. 如果真係想節省資源, 不如就連18歲以上嘅主流學校學生都唔受政府資助, 咁會公平d.

小弟覺得主流學校嘅學生都唔應該無限期受政府資肋law.

你又很難怪他們的﹐醫管局好似係自負盈虧架﹐到有虧損時﹐受害的不就是廣大的市民嗎﹖所以﹐最後錯的其實都是呢個制度同埋政府。。。

另外﹐我都同意麥莊莊說的﹐一係就連主流都唔資助﹐一係就兩者同樣都資助﹐無理由對智障的唔公平嘛。。。呢方面加拿大政府就做得好D。。。需知一個家庭有了智障兒響精神同埋經濟上負擔已經好重﹐政府應該幫下忙。。。

小弟覺得力哥仔成日都怒火中燒唔係辦法...
咁樣會血壓上升同皮質醇偏高, 對身體唔好架...

不過, 好慶幸o係溫哥華咁遠, 都有人對香港咁有心~

You know, Lik is an anti-Chinese moron. He is going to pick on every mistake that the HK goverment does. If he picks on every error committed by the Canadian government instead, he would be very busy. Just look at the big government fiscal deficit here.

What can you (a general you) do as "overseas HK people"? If you are living here in Canada, shouldn't you spend more time to care and love Canada country instead? If you really miss your mother country that much, why not moving back and see what you can do there?

I am living in Canada because I absolutely love it here. The fresh breathe of freedom and democracy is something I would never trade for anything else.

What makes you think I don't care for and Canada? That is a very odd misconception because I certainly pay careful attention to Canadian affairs as well. I have no need to prove anything to you, but others members that know me better probably know where I stand on various federal and provincial issues.

Another reason I don't get nearly as upset on Canadian matters is because unlike the HK SAR government, our various levels governments rarely do anything that is fundamentally and critically flawed. They certainly have their share of screw-ups as well, and the BC Liberals have been cutting it close on their various cutbacks to schools, disability support programs, etc., The Dziekanski incident is infuriating as well, but in general, Canadian governments are still nowhere nearly as immoral and incompetent as the heartless idiots in the HK SAR government.

I guess you have never need to worry about whether you will have bread on your plate, cloth to keep you warm and shelter above your head to keep you dry. So you can call out loud easily that you value freedom and democracy above anything else.

Have you ever heard about Maslow’s five-level Need Hierarchy? The lowest level is “physiological need” – food, air, water and shelter. The second level is “safety need” – secure and stable environment. When you are talking about “freedom and democracy”, it is at least at level three or four.

You may believe you are the true supporter and defender of “freedom and democracy” and we are not. The fact could be the opposite – we may be the true supporters of freedom and democracy. When China is stronger, more stable and having the power to protect its land and citizen, and more importantly its people receive the education needed, and only then, the realization of freedom and democracy can be possible.

If you want to make a valid argument, please at a look at how the democracy of western countries was established and give us the examples and evidences to support your points, but not just bashing other people who are having a different opinion.

Only calling out loud – “my soul is not for sale” does not do any good to the democracy.
