I was driving back to Vancouver this evening, was on the highway in Skagit driving 90mph at 70mph speed limit (I'm not too familiar with miles..) and I got pulled over. First the cop asked me "How often do you check your rear mirrors? I have been following you for 2 miles with my sirens on". In my mind I was like WTF I just saw you, and I was pretty sure you didn't have your sirens on.. I only saw the lights flashing. I got a ticket for speeding - $247.00, and "fail to yield to emergency vehicle" - $1062.00. So a total of $1309.00 which is outrageous!!!!!!!!!!!!!!! I have 3 options: pay for the damn thing, mitigation hearing, or contested hearing. I don't want to pay for it! The amount is half of my life savings @_@ My dad was with me at that time, and he said that he heard from somewhere before that if you don't pay for it, you are just not allowed to enter the states again within the next five years. Is that true??

Then you have the 4th option - Not enter the States for the next 5 years.

wow... you're in for a rough ride... i was ticketed some years ago for speeding + dangerous driving..(only switching lanes too often).. ticket was 400USD... quite affordable compared to yours.. i just paid it.. as i do enjoy my trips to the states.

As far as I know from previous research.., if you don't pay for it, theywill evetually issue a warrant which mean you won't be able to enter the US  (not sure if the warrant would get expire like you suggest?)

However, I would say your best option is to get a lawyer, he/she can most likely do something about it..!

It's not a big deal to me if I'm banned from entering the US, lol. I don't really enjoy traveling there anyways.. I just went today for the drive cause my dad asked me to. But I was just wondering, would that affect my driving record/insurance?

I can see where she is coming from...!  Yet, I do agree with you that it isn't wise to give up your right to enter the US.  It's hard to predict what's when you would actually need to go to the US next.  Rather it's business trip, job opportunity, medical reason...!  Plus, we don't even know if the warrant is only good for 5 years... at this point...!  And 5 years is quite a long time!!

Then again, getting a lawyer isn't that expensive...!  probably some-where between $250-400 for the 2 tickets

It's so dumb to lose your right to enter the US for a thousand bucks.

For that big amount, you should fight for it.

I got tickets before (which was little comapring to you) and I did not pay til the last moment.  It sent me a letter said, it became a criminal offense.  The police had the right to put me in jail next time they saw me in the states, driving or not.

I do not know about the 5 years thing because on the letter it did not say anything about that.

You should at least fight for it and maybe get the 1000 dollar off at least.

check the box for mitigation hearing and request for fine reduced. plus i heard some states will get collection agency to put uncollected charge on your credit report.  And you are banned to drive in that state/states for lifetime.

yes, in Canada if you do not pay, you cannot renew your license but in States, the police has the right to put you in drive if they catch you driving again.

if you were doing 90mph then you are driving at >140 km/h.  even if you are in CAnada it won't be cheap either.  i think you should pay the speeding ticket and dispute the $1000 ticket.

Drive slower next time.  Not familiar with MPH vs KPH is never a valid excuse in front of the cops.  As other said, you were way over the posted speed limit...

You should request to go to court and explain your situation and try to find a reason that it's unsafe to yield at that time so you could not possibly yield the police car.  From some websites, someone stated that the police might even lie how much miles you continue to travel to not to yield.  

Do not say you already yield but the police still ticketed you because it's more likely the judge will believe him than you.

As far as I know, the police actually doesn't need to come.  Instead, they would provide a details report of the incident.  The lawyer actually can make up all kind of technical supports, to make the ticket not valid!

you can try to make a similar case to this..

saying that you are not yielding because you know the police is pulling you over and you were in left lane and you want to make sure it's safe to change to right lane and find a safe place to stop the car.

However, I don't see how "not familiar with MPH vs KPH" as a reason since you're driving ~140 and must be passing almost everyone else on the HW already.

I believe most speeders could spot the cop when they pass him.  So most will immediately slow down and cops seldomly need a long chase.  While, in your case, you don't know where the cop tagged you and where he started to follow you.  You are in a bad situation to argue.

Tell me what you are going to do when "you got an excellent job, but that requires you to go down to US for meeting".  In my previous job, I even need to drive down to WA for meetings and work.

While you may not "like" to go to US, but things not always go along with your will.

you should dispute it while you still have the chance.  If you choose to ignore it and think you will not just go to US now, when the time passes and if you need to go to the states, you cannot dispute anymore and more interests accumulated, you will need to pay more.

My car doesn't have MPH on its speedometer (only KM/H).  A friend of mine was using this excuse when the US cop stopped him but I forgot if he was able to get away with it.

I guess if you are 10 MPH over the speed limit, the cop may just give you a warning if your speedometer doesn't have the MPH marking.  Just use common sense and don't be the fastest one on the road...

I thought she said she was driving 90 mph at a 70 mph zone, which isn't that outrageous. Won't even be considered as excessive (30km/hr above) speeding up here in the great white north??? I mean you can count the percentage of cars doing 110+20~30 on the Coquihalla the next time you drive to Kelowna, it's gonna be quite a few.

Besides, lots of cars do 20 mph above on the I5, so she won't be passing people as if she's doing Gumball 3000. At max she's passing vehicles, but nothing very outrageous either. It's speeding and definately a speeding ticket if caught tho.

What's PITA is that 'fail to yield to emergency vehicle' bit.... gd luck.

Well, maybe not passing everyone and I don't consider she is that outrageous (I have been doing worse).  But if I were driving 90mph in 70mph zone, I wouldn't need to look at my "meter" to know that I'm well over the speed limit.  So just using the unfamiliar meter reading as excuss is pretty lame, I consider.

90 m/h is about 144 km/h...unless she is driving a really quiet car..there's no way you don't know you are driving above 140../haha

Another thing I just noticed on the ticket is that... under violation it says I'm going over 30mph. The cop told me I was going 20 over! I don't think it's fair for me to pay the ticket because it seems like the cop is trying to take advantage of us stereotyped "nice Canadians". I still think he lied to me about having his sirens on for two miles, because if they were on, my sister or dad would had heard it.. however, I was the first one to notice the cop behind me. If I pay the $1500+, I am not only throwing money away, but I'd also lose my dignity.

It will be stupid to be classified as a criminal for $1500.  If you grow up and ever get a job requiring you to goto US for business, you will be doomed.  (let alone you can kiss all the US colleges goodbye).

I think in your case it worth to find a lawyer to go dispute the "fail to yield emergency vehicle" ticket. Just paid the speeding one. In Van, just over 40km/h is considered excessive speeding...and it's very easy to get license suspension.

140 is not even fast

i was doing 140MPH and the cop only gave me a $600 ticket in the states LOL

remember caffie is a little girl, in general, people may think the kid just try to ignore the siren or  the music was too loud.  but if her dad tells the judge the same thing, the judge may tends to believe it, because her dad is a mature person, who shouldn't do anything stupid.
also, she mentioned the cop told her she was 20mph over the limit, but on the ticket, it said 30mph.  if she can proof or the cop admits that was his mistake, she can walk out free.  remember, if the cop made a mistake, the whole ticket will become invalid, because the cop cannot charge you back with 20mph over the limit.
or at least, tell the judge that she had good record and it was the first time, request reduction ma.

I agreed with what Tofu said.  

If your dad is inside the vehicle too, he can prove one of the following:
1. that all of you inside the car did not hear the siren or
2.  the traffic was so busy that caffie cannot pull over immediately.
3. no one realized the police car was behind you.

Just FYI, if you were driving at ~90mph, and if the cop claimed that he followed you for ~2 miles, that means he was following you for ~80secs.

~80secs => call for the backup already?  Did you misread something?

Also, doesn't it really matter whether the siren is on or not?  You have to yield even when the emergency vehicle is flashing its lights.  It maybe an excuse to reduce the fine though, if it didn't have siren on.

Back to 20mph or 30mph over, do you actually know what's your speed at that moment?  The police probably had record on his laser gun, and they usually wrote down a smaller number already.  If you know in fact that you weren't not 30mph over, then yeah, go dispute that.  However, you never mentioned what's your traveling speed so far.
