mtr incident without, stopped, follow, normal, opened

big question.
where does it say on the site that if you enter ...... the premise without BEEPING the octopus card~ you will get fined $500 hkd?

walked in mtr with her octopus. did her normal BEEP octopus motion
the gate opened. she walked in.
then the attendant stopped her and said she didn't BEEP the machine.
O_o!!  shocked as she was walked in the staff room for "investigation" where they just layed out the rule:
you didn't beep the card
you trespassed therefore you're fined.
just be careful next time.

she paid the fine and disputed it~ felt so eat-dead-cat.
the gate opened after her swipe motion~ how does one know if the machine read it or not.
how can one be careful next time if there was a technical difficulty.

MTR confirmed that she did trespass... and didn't refute the charge.
and said since it's her first offence, they will only fine her $500. what.. "offence"  what a diss~~ eat-dead-cat again.

since when penalty is on actus rea and not a combination of mens rea and actus rea?


fine is nothing.
wrongfully accused is a big deal.


i'm trying to find penalty disclaimers.. anything along those lines.

should have requested to see the video.
but the staff only checked the card if read or not.

i think the video would proof that she did do the scan motion.

what is happening is..
they dun care if she did the motion or not.
if the machine didn't read it, and she managed to get in the premise, then she trespass.

B-jai.. i dunno..
maybe fast la~ but i've been fast crossing the entrance and it reads really well.
She is way more experienced with the mtr entrance la~going to work~ coming from work for years.
usual motion of scanning the card is beep and go - habit for years.
Any honest citizen would assume the transaction's done~ go go go.


having said that, i think she should really slow down next time~
the usual efficient (quick to read and enter entrances) entrance is no longer efficient at mtr,   doesn't even give warning...

first time i took the mtr, i slowed down to check my balance.. hahaha i got yelled at from behind.
"5 d la ng goi!"
i can imagine any typical hk residents would beep and go~ need to look back ma?
