Vancouver police apologize after man beaten

The Vancouver Police Department has issued an apology after a man said he was beaten by officers who knocked on the wrong door while investigating a report of a violent domestic dispute.

Plainclothes officers arrived at the right house at 2 a.m. PT Wednesday near Knight and 49th Street in East Vancouver, but they were at the wrong suite, police admitted in a news release Thursday.

Speaking through a translator, Yao Wei Wu told CBC News that as soon as he opened the door the officers pulled him out of the house and beat him.

He was hit multiple times on the back, head and face, said Yao, 44.

He said he did not resist because the men had guns.

It was only after they handcuffed him and asked his name that they appeared to realize they had the wrong man, Yao said.

The officers then called for an ambulance and a Cantonese-speaking police officer.

Yao was taken to hospital where he said doctors found fractured bones around his eye and multiple bruises on his back.

"A full and thorough internal investigation has been launched into the case of an eastside resident who was injured and arrested in a case of mistaken identity," Const. Jana McGuinness said in a news release.

The officers didn't realize there were two separate residences in the house, McGuinness said.

"The man resisted by striking out at the police and trying to slam the door, but the officers persisted in the belief that there may be a woman and child inside who could be in danger."

The man the police were looking for who lived in the other suite in the house was later found and arrested on suspicion of assault, McGuinness said.

News1130 legal expert Michael Shapray says a person who believes the police have mistreated them can always sue them.  "The police are not immune from being sued civilly.  There are certainly time limitations on doing that, but they are not immune to that.

He adds the amount of compensation a person could get from such a suit depends on individual circumstances.  He says you can also go to the Police Complaint Commission if you feel you have been abused by police.

Shapray says you could also ask for a criminal investigation.  He says some may find the last two options less than satisfying because you don't get any compensation for any injuries that might have been caused.

My impression of the RCMP and the VPD is that this type of scandals and PR nightmares have started to rise since the days of Jamie Graham, although the ol'boys club mentality has probably permeated long before that.

While I didn't really like Jamie Graham as the VPD Chief, I don't really know if the faults of the front line officers can be entirely blamed on either Jamie Graham or Jim Chu. One thing to keep in mind is, the city has seen tremendous growth while neither police funding nor human resources were given increases that could match the city's growth and its growing crimes (pot, drugs, gangs, etc.). Essentially, the force had to make do with what they had to handle a larger population. With heavier workloads, it is not surprising to see a drop in the quality of service. If I am not mistaken, it wasn't until Chief Chu came into power that the VPD saw a meaningful growth in the size of the force.

Ultimately, I agree that the inability of the police chief to prevent these incidents from happening, and the fact that offending officers rarely seem to get the punishment they deserve have to be born by the chief officer. However, I would say that as far as damage control is concerned, Chief Chu has has done an amazing job in making the best out of the bad situations that he has been thrown into.
