Huh? Isn't it common sense that it's dangerous to stop in the middle of the highway, even if you have hazards on? I'd think it's kinda dangerous even if it's pulled to the side, let alone in the middle of the highway. I'd definately want to stay well clear of the vehicle if possible in that situation. I'd say Miller is also the victim of the whole ordeal, having to go through all these because the cab driver is not able to pull to the side of the road before the vehicle is undrivable... I mean unless you have lost steering, how hard is it to pull a car to the side? Miller did get thrown mulitple lanes across and could've been killed from a T-bone himself if not for that it's a more modern SUV. Imagine if he was driving a Ford Tinto, definatley dead and won't live to see the courts. See whose the ones getting blamed if that's the outcome for the same actions taken from all parties.
Miller did nothing wrong aside from driving illegally in HOV (probably it was just himself but nobody else). Perhaps not paying tip top 100% attention to the road. Who can say they pay 100% attention 100% of the times when driving anyways. If not paying 100% attention to the road constitute 'driving without due care', then the government can probably collect a fine from almost everyone almost every other time they drive. There are a lot of reasons why someone might not able to stop the car in time and many reasons might not necassarily be illegal. Afterall, a car stopping in the middle of the highway is not exactly expected. I'd say more people drive without 100% attention and drive illegally on the HOV without causing any accidents 99.99999% of the time. It's more like stopping the car in the middle of the road that's abnormal and the main cause of the deaths. If not for the accident, getting fined $1500 for not paying 100% attention to the road and for driving illegal on the HOV is ridiculously excessive. And of course, driving a BMW doesn't help. Who doesn't hate the rich and blame the poor these days? And BMW drivers aren't even rich... the cheapest BMWs these days is the price of a higher-end Honda... I'd say the final verdict of fining him $1500 is about right given the outcome of the accident.
North American and their sue happy victim mentality. People gotta be responsible for putting themselves vulnerable once in a while, don't they? And not everything have a blame. There are acts of gods, and also accidents. Suing someone else for your own misfortune does not make the world any better. |
