Vancouver driver involved in a 2008 Coquitlam crash in which two young boys were killed and their brother paralyzed, has been fined $1,500.
Ryan John Stewart Miller, 31, pleaded guilty Monday to driving without due care and attention — the charge laid against him — in Port Coquitlam Provincial Court.
Under the Motor Vehicle Act, a driver found guilty of the offence could face a maximum fine of $2,000, six months in jail, or both.
On Wednesday, Miller was fined $1,500 and asked to pay a $225 victim surcharge fee, said Crown counsel spokesman Neil MacKenzie.
The incident occurred around 9 a.m. on Nov. 29, 2008, when Miller’s BMW SUV rammed into the rear-end of an eastbound minivan stopped with hazard lights on in the HOV lane of Highway 1.
Maria Moeller had stopped the vehicle after its cab started to fill with smoke, which was visible to other vehicles in the area, RCMP Sgt. Peter Thiessen said at the time. Miller was driving illegally in the lane when he crashed into the van, killing nine-year-old Andrew Moeller, his six-year-old brother Matthew, and paralyzing eight-year-old Karl, all were seated in the third seat of the minivan. Two adults in the van were also seriously injured.
Following the collision, the BMV spun 90 degrees and was hit by a third vehicle also travelling eastbound in the HOV lane, police said.
Shortly after Miller was charged, he left Canada for Australia, but was arrested July 1, 2011, when he returned to this country.
MacKenzie said the Crown had asked the court to consider a “brief driving prohibition” in addition to the fine, but it was not granted.

Nov. 29, 2008. Serious three-vehicle collision on Highway 1 Saturday morning: a grey Toyota minivan with 8 occupants in the eastbound HOV lane just west of the United Boulevard exit was hit by a BMW which was in turn hit by a third car travelling in the HOV lane.

It's know this was from years back, but any reason why the Van was stopped at a HOV lane?  And was there no room to pull to the side of the road?

I guess it was Maria with the kids who got hit.  The driver really should have pull the car to the side of the road.  Yet, $1500- what a joke!!

Huh? Isn't it common sense that it's dangerous to stop in the middle of the highway, even if you have hazards on? I'd think it's kinda dangerous even if it's pulled to the side, let alone in the middle of the highway. I'd definately want to stay well clear of the vehicle if possible in that situation. I'd say Miller is also the victim of the whole ordeal, having to go through all these because the cab driver is not able to pull to the side of the road before the vehicle is undrivable... I mean unless you have lost steering, how hard is it to pull a car to the side? Miller did get thrown mulitple lanes across and could've been killed from a T-bone himself if not for that it's a more modern SUV. Imagine if he was driving a Ford Tinto, definatley dead and won't live to see the courts. See whose the ones getting blamed if that's the outcome for the same actions taken from all parties.

Miller did nothing wrong aside from driving illegally in HOV (probably it was just himself but nobody else). Perhaps not paying tip top 100% attention to the road. Who can say they pay 100% attention 100% of the times when driving anyways. If not paying 100% attention to the road constitute 'driving without due care', then the government can probably collect a fine from almost everyone almost every other time they drive. There are a lot of reasons why someone might not able to stop the car in time and many reasons might not necassarily be illegal. Afterall, a car stopping in the middle of the highway is not exactly expected. I'd say more people drive without 100% attention and drive illegally on the HOV without causing any accidents 99.99999% of the time. It's more like stopping the car in the middle of the road that's abnormal and the main cause of the deaths. If not for the accident, getting fined $1500 for not paying 100% attention to the road and for driving illegal on the HOV is ridiculously excessive. And of course, driving a BMW doesn't help. Who doesn't hate the rich and blame the poor these days? And BMW drivers aren't even rich... the cheapest BMWs these days is the price of a higher-end Honda... I'd say the final verdict of fining him $1500 is about right given the outcome of the accident.

North American and their sue happy victim mentality. People gotta be responsible for putting themselves vulnerable once in a while, don't they? And not everything have a blame. There are acts of gods, and also accidents. Suing someone else for your own misfortune does not make the world any better.

Why you want to twist the words.  He got fined because he pleaded guilty to drive without due care and attention, and not because of anything else like you added.

If you read other news source, the news said he changed lane shortly before the incident.  Now let me ask what usually is the reason that a non HOV driver change lane to the HOV lane?  I said, to overpass another vehicle which is on the fast lane.  Is he speeding, I dont know.  The news doesn't say.

Also no where the news said any car got thrown multiple lanes across, the BMW only got spun around 90 degree and got hit by another car in the HOV lane.
