You should at least attempt to fix it, cause "IF" it's completely untreated, they have a right to fix it themselves and bill you for it.   If your rental agreement said "fridge", then all parts of the fridge is included.  Let's say the freezer broke, you can't go "oh I only rent the fridge and not the freezer" right?   

Remember, the RTA will favor the tenant and not the owner most of the time, and you don't want them involved.

If you want to kick them out, you have to give 2 month notice and can't charge them the last month's rent, do you want to do that?

You should certainly visit the apartment at least once in a while (every 3-6 months), but you have to give ample notice (more than 24 hours), and they can't refuse your entry.  Just inspect the house, look for defects.  You can even get them to sign an inspection report detailing the deficiencies they have caused the apartment.  This way you know they haven't wreaked anything (appliance, carpet, wall, etc).

We decided to hire a licensed technician to see what happened to avoid the dispute.  

The tenant had already finished 1st year "fixed" leased, according to our agreement signed between ourselves, any party want to terminate the agreement by giving 1 month notice.  So, I'm a bit confused what you meant " we can't charge them the last month's rent"  Anything we miss/misunderstand RTA's regulation? It is the first time for us being a landlord.

Another question I want to ask: my tenant quoted a number of terms & condition in "tendency agreement" from the RTA's website, such as landlord is responsible to "clean out the dryer exhaust pipe and outside vent at reasonable intervals" which is not a part in of the agreement we signed.  Is it mandatory for us to abide the agreement set by RTA?  If so, you are really right, RTA protect tenant rather than landlord.

Sorry, but I'm on your tenant side in this case here.  It is well known that RTA protects tenant.  So if RTA gets involve in your case, you will have an uphill battle.

1) fridge refers to this one appliance you provided in the unit for the tenant.  So if any part of that fridge is malfunctioned, for me it is reasonable to ask you to fix it.  If you eventually have to replace the fridge without an ice dispenser, I think you better get the agreement with the tenant first as well.

2) dryer pipe/vent.  since your own tendancy agreement doesn't mention about this, RTA will base it off their guideline which means you will have to clean out.  What's a reasonable intervals?  I can't say.  My previous apartment cleans them once a year.  You could hire technician to do that inside the house and it shouldn't cost a lot.  I will just do that if I were you.  Also, sounds like it is a well known problem from the builder.  Has your strata brought this up with the builder?  My previous apartment has an extra blower fan into the dryer pipe to reduce the build up.

Hope this gives you a different view on your case here.

雖然我都係個包租婆,但係租得間屋俾人住,就預咗㗎啦,啱啱租俾我租客,頭個三個月真係吹脹,可能佢第一次自己搬離屋企啦, 連個門個螺絲鬆咗都text 我叫我去整,事關佢有啲大鄉理,見屋院有security,以為保安差,差實係對面樓花開始起!

我但求佢唔好將我間屋當大麻屋,唔好養狗,唔好撞到啲野爛到飛起,個個月張票唔彈,我都偷笑!我都就嚟同佢一年約滿,雖然三次上去,佢都住得好整齊,但都諗住到約滿時約佢驗吓間屋,因為我每次都係個客廳同佢傾計!


下次咪同新租客friend 啲囉,我都有真心關心佢哋住成點,有咩幫手, 佢都同我update 吓層樓個排有咩變動,麻煩野!

Sorry.... Didn't know your signed contract is over, I thought you still have a contract (I thought you had a contract and want to "kick" them out).
RTA will always take the side of the tenant (unless they have something super crazy or didn't pay you).  Try to complaint to the Strata if the air vent is a known problem.

The contract is over and now it is " 生約" , either of us give 1 month notice if any party want to terminate the agreement.   

Frankly, those issues particular about RTA that you mentioned we never think or expect it.  Now, we know what it is about and are pleased to be a cooperative landlord.  At one point, we want to kick out the tenant but consider the market situation; we will try to keep them if they are not demanding.  They told us they want to paint the wall as they think it is not match with their furniture/setting when we came to our unit for checking the ice-dispenser.  We turned them down as we think it is a not make sense request. If they take this as an excuse to terminate the agreement, we’d let them go.

Thanks for reminding us to complaint to the Strata to see if they can do something on the air vent, at the meanwhile, we will find someone to clean it up.  Hope it won't cost too much.

其實我地俾佢好大的自由度...住左成年, 我地無話入去睇下攪咩鬼, 亦俾佢養狗.

諗住單位細, 我地專登買左個drop-leave table兼搵師傅裝好係個牆度,佢租時問可唔可以移去另外一邊,已經同佢釋過話因地方有限,唔好轉,點知過左幾日同我地講話上牆的螺絲唔知點解跌左入牆度,我地估佢肯定唔聽話自己想鑽開粒螺絲移位, 我地都無話佢,淨係叫佢唔好放重野落張枱...

試過有次入票, teller查度佢個戶口無錢, 叫我地唔好入, 我地打俾佢, 誓神劈願話有入, 最後就叫我地夜晚晚特登由richmond開車到vancouver問佢攞租, 去到先賴老婆唔記得入票

從來無諗過做包租婆原黎係咁煩

    Actually, I'll be more cautious if the tenant want to keep a dog. 'Coz some strata has by-law that no dogs allow...
