台北地方院今天判決，酒後駕車部分判處拘役五十天，易科罰金以新台幣一千元折算一天；過失致死部分則判處有期徒刑六個月，易科罰金以一千元折算一天，均可緩刑兩年。

判決指出，林曉培自知無駕照，卻在酒後注意力降低下駕車，致被害人死亡，觸犯服用酒類、不能安全駕駛動力交通工具而駕駛罪，及過失致人於死罪。但犯後跟警方自首，態度良好，顯有悔意，於是從輕量刑。

另外，審酌林曉培和被害人家屬已在簡易庭達成民事和解，賠償八百萬元、不再追究她的刑事責任，因此緩刑兩年。全案仍可上訴。
