hahaha
both issues, I can sort of call myself an "expert" in.
For the refund thing, legally there is no right to refund something unless it is dead on arrival or the store somehow lied to you regarding certain features. However, if the store puts up a sign with their return policy, then they have to follow it regardless. in your case, it will highly depend on whether you asked them the policy or whether it was posted at cashier or printed on the receipt. If it clearly said no return, then they are correct. However, if it is not listed, it is always good to ask.
For the tips issues, I ran into it before myself and surprisingly my coworker just asked me a few minutes ago. My response to him "Under the constitution of Canada, we have been a country for over 100 years. There is no law in federal, provincial or municipal level which states implicitly or explicitly that a tip has to be given. In fact, if you were to charge a tip that is mandatory, you should provide me with sufficient notice before I entered the restaurant and also before I order. And with the lack of any of the above, I refuse to pay the tip. If you have any concerns, feel free to call the police. Otherwise, I am leaving now. You can talk to my lawyer" that will be the response I will give.
In short, unless the store posted clear signs in the entrance or notified you regarding the requirement for tipping 10% prior to your order, you are under no legal obligation to pay. As long as you pay the cost of your meal, you are good. If I were in that case, I will not pay the 10%. I will just tell them to call the police. If they try to hold me back...be prepared to a false arrest lawsuit
I am not a lawyer, so the above is not legal advice and is simply my personal opinion. |
